BidFresh may suspend or terminate accounts involved in fraudulent, unlawful, or abusive activities.

BidFresh provides a digital marketplace that enables users to:

• Compare product prices.
• Browse retailer catalogues.
• Place purchase orders.
• Receive quotations where applicable.
• Track orders.
• Manage purchasing activities.

BidFresh acts as a technology platform and does not guarantee the availability, quality, or suitability of products offered by third-party sellers.

When placing an order, users agree that:

• All information submitted is accurate.
• Orders are subject to seller acceptance where applicable.
• Sellers may reject orders due to stock availability or operational reasons.
• Prices displayed may change until an order is confirmed, unless a fixed-price campaign specifically states otherwise.

Product prices are determined by individual retailers.

BidFresh may display:

• Market prices
• Promotional prices
• Fixed-price campaigns
• Price comparisons

Prices may exclude delivery fees, taxes, or other applicable charges unless otherwise stated.

Payments may be processed through approved third-party payment providers.

Users agree to:

• Pay all applicable charges.
• Provide valid payment information.
• Authorise payment processing for confirmed purchases.

BidFresh is not responsible for delays caused by banks or payment providers.

Delivery services may be provided by:

• The retailer
• The buyer (self-collection)
• Third-party logistics providers
• BidFresh delivery services, where available

Estimated delivery times are indicative only and may vary due to operational or external factors.

Cancellation and refund eligibility depends on:

• Order status
• Seller policies
• Applicable laws

Approved refunds will be processed using the original payment method where reasonably possible.

Users must not:

• Provide false information.
• Upload harmful software or malicious code.
• Attempt unauthorised access to the Platform.
• Manipulate prices or transactions.
• Interfere with the operation of the Platform.
• Infringe the intellectual property rights of others.
• Use the Platform for unlawful purposes.

Retailers are responsible for:

• Maintaining accurate product information.
• Updating inventory levels.
• Displaying correct pricing.
• Fulfilling accepted orders.
• Complying with applicable food safety and business regulations.

Buyers are responsible for:

• Providing accurate delivery information.
• Reviewing orders before submission.
• Making payment when required.
• Inspecting goods upon delivery and reporting issues within the applicable timeframe.

All Platform content, including software, designs, logos, trademarks, text, graphics, and other materials, is owned by or licensed to BidFresh unless otherwise stated.

Users may not reproduce, distribute, modify, or commercially exploit any Platform content without prior written permission.

To the maximum extent permitted by law, BidFresh is not liable for:

• Product quality issues.
• Stock shortages.
• Delivery delays.
• Business losses.
• Loss of profits.
• Indirect or consequential damages.
• Disputes between buyers and sellers.

Nothing in these Terms excludes liability that cannot legally be excluded.

BidFresh may suspend or terminate accounts that:

• Violate these Terms.
• Engage in fraudulent conduct.
• Abuse the Platform.
• Pose security or operational risks.

Users may stop using the Platform at any time, subject to any outstanding obligations.

Your use of the Platform is also governed by the BidFresh Privacy Policy.

BidFresh may amend these Terms from time to time.

Updated Terms will become effective upon publication on the Platform. Continued use of the Platform constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Malaysia.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Malaysia, unless otherwise required by applicable law.
